Welcome to our comprehensive Seller Playbook, your go-to resource for navigating the world of Jane. We're here to help you succeed while maintaining the highest ethical standards in your business journey.
Advertising & Marketing
This policy is a part of our Terms of Use. By participating in any of Jane’s advertising and marketing services, you’re agreeing to comply with this policy and our Terms of Use. This Advertising & Marketing Policy may be amended from time to time, per Jane’s Terms of Use. By continuing to participate in Jane’s services you agree to those amendments.
At the heart of Jane’s operating philosophy is to work alongside sellers in starting and growing their businesses on our platform. Part of this partnership includes working with sellers to ensure their best products can get more exposure through promotions. This Advertising & Marketing Policy details how you can participate in Jane’s advertising and marketing programs.
Everyday Promotions at Jane
Every day, our platform attracts millions of views from across the country. We work hard to make sure our platform connects those visiting the Jane platform, with the amazing products that our sellers offer.
As one of the industry’s top curated marketplaces, our merchandise and marketing teams are working every day behind the scenes to create compelling promotional content that features the very best products from small businesses like yours.
Your listings and/or storefront may be included, at Jane’s sole discretion, in our marketing content to help increase the visibility and expand the reach of your products.
While our teams are constantly searching for great products to be featured, we encourage sellers to connect with their account managers to learn more about the key factors that go into our selection process (i.e. promotional relevance, listing quality, etc.) as well as opportunities to be featured.
Disclaimer
Jane reserves the right to change the terms of this Advertising and Marketing Policy at any time, including the addition or removal of new program offerings.
While Jane strives to optimize the outcomes for sellers participating in our Advertising and Marketing programs, Jane does not guarantee that a featured product will generate clicks, orders or revenue from users visiting Jane’s platform.
By participating in Jane’s Advertising and Marketing programs, sellers agree that their featured product will not infringe upon or violate the rights of any third party, including copyright, trademark, privacy, publicity, or other personal proprietary rights. Sellers remain responsible for making sure that their products are compliant.
Jane reserves the right to reject and/or remove any product feature for any reason, at our sole discretion, if we believe it negatively impacts the experience we are creating for our customers and broader seller community. This includes but is not limited to instances where a featured product violates our policies, fails to meet quality standards, or is deemed inappropriate or misleading.
Code of Conduct & Ethics
Jane is committed to conducting business ethically, maintaining safe working conditions, and advancing social and environmental responsibility. Accordingly, we expect our Sellers, their employees, agents, vendors, suppliers, and subcontractors to abide by the following guidance in this Code of Conduct and Ethics along with all applicable laws and regulations, including safety, labor, and employment laws.
Jane expects Sellers to have strong corporate governance in place to support their compliance with this Code of Conduct. Jane may audit a Seller upon reasonable notice to help confirm compliance with this Code of Conduct.
If Jane becomes aware that products are manufactured or sourced from unsafe or exploitative conditions, we may contact you for the following information:
- Demonstration of policies that align with Jane’s Code of Conduct and Ethics.
- Knowledge of, and ability to provide, factory information for where your products are produced or manufactured.
- Examples of your social auditing protocols, processes for assessing facility working conditions, or participation in an approved industry association that requires factory monitoring.
Jane reserves the right to discontinue a Seller relationship and withhold payments in the event they are found to be acting unlawfully or in violation of this Code of Conduct or any applicable Jane policy.
Jane may reach out for additional information to determine sellers' commitment to these ethical expectations.
Business Integrity
Conflicts of Interest
Sellers will disclose all known family or close personal relationships with Jane employees or directors who are involved in the Seller’s engagement with Jane. Sellers must not deal directly with any Jane employee whose spouse, domestic partner, or other relative has an interest in the Seller as an employee, partner, owner, investor, or similar roles.
Gifts and Hospitality
Sellers should avoid giving gifts, entertainment, or other hospitality that might influence, or appear to influence, the decision making of Jane employees or agents. If given at all, hospitality, such as providing meals to Jane employees, should be moderate and infrequent. Sellers should use good judgment and hospitality must comply with U.S. and local law.
Cash or cash equivalents such as gift cards or shopping vouchers in any amount are prohibited. Sellers will not offer any other goods, services, business opportunities, commissions or advantageous financial arrangements that would personally benefit a Jane employee.
Gifts that violate Jane policies will be returned to the Seller or handled in a manner that complies with our internal policies. Reasonable and customary business meals or entertainment in furtherance of the business relationship are permissible.
Records Management
Sellers must ensure their accounting and financial records accurately reflect their business practices and comply with all applicable laws and regulations regarding such information.

Sellers will comply with all applicable privacy and information security laws and regulatory requirements when personal information is collected, received, stored, processed, transmitted and shared. These applicable laws and regulations may require that sellers post and comply with their own privacy policy or privacy notice, which must be accessible to Jane customers with whom sellers interact on the Jane platform.
Do not send unsolicited commercial email messages, telemarketing phone calls or text messages, or any sort of direct mail to Jane customers. Misuse of customer information, including but not limited to the customer’s email address, is a violation of the Jane Seller Contract and may also be infringing on applicable privacy laws, including regulations and/or rules relating to direct marketing, advertising, targeting, e-mails, text messages, robocalls, telemarketing or other electronic commercial messages, including without limitation the CAN-SPAM Act and other applicable legal and regulatory requirements.

Commission & Seller Fees
Commission
Jane will retain a commission for each Seller Product sold through the Jane Platform or through Third-Party Channels, which commission shall be at the applicable Commission Rate (as set forth in the chart below) and based on the full product listing price for the applicable Seller Product. The full product listing price shall include both the base product price and all shipping, handling, and other relevant charges (other than applicable taxes). In determining the applicable Commission Rate, Jane shall have the right, in its sole judgment and discretion, to determine the appropriate Seller Product Type category for each individual Seller Product. Jane also reserves the right to adjust or change the product type categories at any time. All decisions by Jane with respect thereto shall be final.
Referral Fee
This fee (as set forth in the chart below) applies to all orders, including orders that come through Facebook and Instagram. The referral fee will only be charged when an order has been placed and will appear as a separate line item in the seller ledger. The fee will be applied per order.
The referral fee will be refunded if the customer cancels the order before shipment. The referral fee will not be refunded if the customer returns the product and/or if the seller cancels the order before shipment.
This policy will be assessed starting in 2025. Sellers will receive at least 30 days' notice prior to the implementation date.
Listing Fee
This fee (as set forth in the chart below) applies to all product listings created by sellers. The listing fee will be charged per seller product listing or every 90 days if a product has not made a sale. The listing fee will be applied as a separate line item in the seller ledger.
The listing fee will be charged upon the publishing of each product listing. If a product does not sell within 90 days, the listing fee will be reapplied. This cycle will continue every 90 days until the product listing is removed or unpublished by the seller. Additionally, if a seller removes or unpublished a listing and then decides to re-list it, the listing fee will be charges again upon republishing.
The listing fee is non-refundable, regardless of whether the product sells or is removed from the marketplace.

Copyright Infringement
If you believe that any content on the Jane platform or the Jane website infringes your copyright, you may request removal of such content in accordance with the processes outlined in our Terms of Use.
Handmade and Personalized
Jane considers handmade and personalized items to be items that are custom-made and/or designed by you, the seller. This also includes the processes of printing, 3D printing, casting, plating, engraving, cutting, sewing and finishing.
We love seeing handmade and personalized items on Jane. We know how much work it takes to create these unique products, and we want to make sure you have the time and resources you need to complete your craftsmanship. That’s why we’ve given sellers who propose handmade or personalized items more time to fulfill their orders. All paid handmade or personalized orders, including graphic tees, must be fulfilled within 6 days of order confirmation. If required personalization information is missing from the order confirmation, it is the seller’s responsibility to contact the customer, collect the required information, and fulfill the order within the required 6 days after order confirmation. Order fulfillment should begin the moment a successful order is completed.
Any items that are not physically made by you, but are handmade by an artisan or charitable organization may still have a handmade marker included in the title and description, but they are excluded from handmade benefits. This includes products that are personalized, but not made-to-order (for example, initial necklaces/charms/bracelets that are sourced but not made by the seller).
While you may still sell handmade or personalized items that are created, designed or made by others, you may only check the box of personalized/handmade during the product listing process and receive the associated accommodations if you meet the criteria listed below.
If your product is marked with the personalized/handmade checkbox during the product listing process, you’re affirming that:
- The product is designed, made, assembled and/or printed by you.
- You own the imagery that you publish in the listing. Stock photos, font/color/text renderings or photos used by other sellers or sites are prohibited. The main imagery must show the final and finished product. Renderings of other possible made-to-order options may be included within your additional imagery.
- You have all the materials on hand to begin making and fulfilling orders at the time the listing goes live on the website.
The personalized box should only be selected if a customer needs to write in a specific request (for example, name, quote, phrase, grade, mascot, etc.). If this is not the case, only the handmade box should be selected.
Note that Jane reserves the right to inquire where the item is made and what tools and equipment are used in making it, as well as to request a sample of the proposed product in its final packaging. Jane also reserves the right to request information about where you produce your products and who assists with production.
Made in The USA Claims
Please note that US law has specific requirements for listing a product’s country of origin and on products listed as being “Made in the USA.”
Example #1: Products made of U.S. materials and also made entirely in the U.S. must be labeled "Made in USA" or with an equivalent phrase.
Example #2: For items any imported textiles and wool products that are sold in the US, the item must identify the country of origin.
Example #3: Products manufactured in another country, but assembled or transformed inside the USA may require the disclosure of both countries.
You should refer to FTC Guidelines to be certain your product listing is consistent with current laws and regulations.
Inventory
The Jane Seller Contract requires that all inventory for a listing be on-hand and available before starting the listing. This applies to any inventory added after the listing is live. Do not list inventory that isn’t immediately available for shipping. Inventory listed for sale must be reserved for Jane customers and cannot be adjusted or canceled based on sales through other platforms.
See the Shipping and Fulfillment Policy for more information.
Listing Fraud
One of the most important things in providing a great shopping experience for a customer is being upfront and honest from beginning to end. Jane is a marketplace made up of thousands of sellers, each with their own unique stories. Transparency helps build a level of trust between you and the customer, and in turn builds trust in the Jane marketplace. The most valuable currency in the Jane marketplace is trust.
These activities are considered fraudulent and are strictly prohibited on the Jane platform:
- Purchasing your own products from the Jane platform.
- Encouraging others—including family, friends or company employees—to purchase products from the Jane platform for the purpose of inflating and falsifying sales numbers (often referred to as “shill buying”). Transactions and reviews between family, friends or current customers is not considered shilling as long as they reflect the honest, unbiased opinion of the buyer as long as the buyer and seller do not share a material connection (such as a shared bank account, credit card, or financial interest in the seller account).
- Creating multiple seller accounts to represent the same business/entity.
- Sending packages to an address that doesn’t match the address on the order confirmation, unless directly requested by the customer.
- Creating or using additional customer accounts to take inauthentic action on the primary seller’s account (often referred to as “sock puppetry”).
- Falsely inflating the reviews of your products by submitting false reviews.
- Offering a reward, discount, free product or other compensation to an entity or person in exchange for a review of your product or the product of another seller.
- Offering a reward, refund or reimbursement to a customer after they leave a positive review on the product.
- Offering a reward, refund or reimbursement to a customer after their purchase to incentivize a review. This includes any product packaging sent in product fulfillment.
- Diverting a negative review to be sent to the seller or through a different review mechanism while positive reviews are left on the Jane platform.
- Leaving fake reviews on the products of another seller.
- Shipping incorrect or false products.
- Uploading previously used tracking numbers (See also, Fulfillment Policy).
- Purchasing or utilizing un-authentic “likes” on your product listings.
Jane has a zero-tolerance policy towards any product listing violations. If we detect any attempts to manipulate customer reviews or product rankings, we take immediate actions that include, but are not limited to:
- Immediate and permanent withdrawal of the seller’s selling privileges on the Jane platform and withholding of funds
- The removal of all the product’s reviews and preventing the product and seller from receiving future reviews
- Legal action against the seller, including lawsuits and referral to civil and criminal enforcement authorities
- Disclosing the seller’s name and other related information publicly
Intellectual Property
Products listed on the Jane platform may not be the intellectual property of others. Sellers may only list products for which they own the intellectual property rights or for which they have permission to list. Listing products which infringe on any trademark, copyright, or patent will result in the product being blocked and seller account suspension.
Additionally, the product listing title, description, images or other listing details may not infringe on any trademark, copyright, or patent. See the Product Listing Quality Policy for more. We strongly urge you to thoroughly review all policies in the Seller Playbook and immediately correct any violating actions. It is also important that you educate your business partners, employees, and any third-party partners you work with about these policies as well. Any infractions by your business partners, employees, or third party agencies will result in enforcement actions, even if it happened without your knowledge or consent.
Quality Controls and Enforcement
- Products will be subject to random test buys that serves as another mechanism to ensure compliance with these requirements. Jane reserves the right to conduct test buys at its own discretion. Products purchased for this purpose will be returned to the seller as per the regular returns process and will not affect any performance metrics.
- Failure to comply with the Product Listing Quality Policy or the Listing Fraud Policy could lead to the removal of selling privileges on Jane, and could require the submission of a ‘Plan of Action’ to remediate and regain selling privileges.
- At any given point and at its sole discretion, Jane reserves the right to remove any selling privileges if it is believed that an optimal customer experience is compromised.
For any questions and clarifications, please contact your Jane seller team representative.
Pricing
For each product that you list on the Jane platform, you will provide the price at which you will sell the product (the “Selling Price”) as well as the shipping fees for that product (the “Shipping Price”). For a given product, the amount a customer pays when they complete the purchase of the product will be defined as the “Total Price.” The Total Price = the Selling Price + Shipping Price.
Minimum Price
The lowest Total Price allowed on Jane for a single product is $1.99.
MSRP, RRP, SRP
The Selling Price, or the manufacturer’s suggested retail price (MSRP), or the recommended retail price (RRP) or the suggested retail price (SRP)—all types of comparison pricing—must be truthful and not misleading. An MSRP, RRP or SRP may be deceptive or misleading and potentially unlawful if it is not a price at which the item was listed and sold for a reasonable length of time.
The listed product selling price should not differ significantly from the reference price at which a product is generally sold. Sellers should take care when using MSRP, RRP or SRP to ensure that the price accurately reflects the price that consumers will generally pay for the product across the market. The fact that a price was recommended by the manufacturer is not in itself sufficient to demonstrate that it is the price that consumers will generally have to pay.
Sellers should not artificially inflate prices on their own website or other online sales channels to create parity pricing with the same product listed on Jane.
Parity Pricing
Jane must offer competitive parity pricing. The Selling Price listed on the Jane platform should not be greater than the price of the same product sold on the seller’s own website or any other online sales channels controlled by the seller.
Pricing Examples
- Unacceptable: Seller lists a product on Jane for $20.99. Seller offers the same product on another online sales channel for $19.99.
- Acceptable: Seller lists a product on Jane for $24.99. Seller offers the same product on another online sales channel for $27.99.
Prices of products on the Jane platform—both the Selling Price (“was” price) and the Promotional Price (“is” price)—must also represent the real value of the product being sold. It’s important that the price represents a genuine, established, usual selling price and will not mislead.
Sellers are responsible for complying with these important legal obligations.
Sellers must ensure that the higher "was" price they use to show savings is well-established and based on recent pricing, sales data, and distribution channels.
If questioned by Jane or customers, sellers must provide evidence that their Selling Price is genuine and realistic by demonstrating significant sales at the "was" price.
Price Changes
If the product selling price is increased during an ongoing scheduled price reduction promotional event, the listing will be removed from all promotional events. Please refer to the Product Listing Quality Policy.
Product Listing Quality
When selling on the Jane platform, success often depends on the details. Whether it’s including information like fabric content or wash and care instructions in your listing description, or including expected size and fit details, the small things will make a big impression on our respective customers.
The product listing requirements outlined below are intended to serve as a minimum required bar for all product categories. If the product selling price is increased during an ongoing scheduled price reduction promotional event, the listing will be removed from all promotional events.
General Product Quality Requirements
Sellers are solely responsible for the content of product listings (including description, price, fees, any required legal disclosures, etc.).
Unless specifically approved and edited by a representative at Jane, promotional language (Ex: “Temporary Price Drop,” “Limited time offer,” “Best deal,” “Exclusive discount,” “Lowest price guaranteed,” etc.) is prohibited in the title, product details, description, and fine print.
From time-to-time, and at Jane’s discretion, Jane will add exclusive images to specific Deals, for sole use on Jane.com. These images are considered proprietary to Jane, and shall not be downloaded, copied or used on any other platform or website, including the Seller’s own website(s).
The details for each product listed on Jane must be kept accurate and complete at all times. If a product is not accurate, please contact the Jane Deal Support team immediately so updates can be made.
Product listings which intentionally attempt to mislead or inflate the value of the product are prohibited. Jane will instruct the seller to correct misleading product listings. Any seller with an excessive number of misleading products risks suspension or expulsion from the Jane platform.
All products must meet the following requirements:
- All products must comply with the Jane Prohibited Items Policy at all times. While Jane will make all reasonable efforts to update sellers on any changes to the Prohibited Items Policy, it is the seller’s responsibility to stay informed of the rules outlined in the policy and maintain compliance.
- Creating a product listing for any other purpose other than to sell a product through the Jane Marketplace or its affiliate is prohibited.
- The use of false, inaccurate, or misleading product identification information, including but not limited to name, description, brand and model, in a product listing is prohibited.
- Creating multiple new product listings for a single product is prohibited.
- Product listings should be as descriptive as possible, highlighting the features and benefits of an item.
- Products should be properly categorized to the most specific department category on Jane.
- The final product purchase price including shipping fees should not be greater than the price of the same product sold on the seller's own site or any other online sales channels controlled by the seller. See also, Jane’s Pricing Policy.
- Seller must specify the cost of shipping and should not exceed industry-standard rates.
- Seller must never list or sell an out-of-stock item.
- A listing from which a person chooses a wrapped item at random without knowing the contents, are prohibited on Jane. Every option needs to be disclosed and chosen by the consumer.
- While not required, inclusion of all applicable manuals or product instructions is highly encouraged in order to provide a better customer experience and aid in the reduction of negative reviews and product returns. In the absence of physical instruction manuals, a link or reference to the manufacturer’s instruction manual should be included, when possible.
- Be yourself. Impersonation of other people, other entities, or Jane employees is not allowed, regardless of affiliation. Posting another person’s or entity’s personal information in any form is prohibited.
- Product names, descriptions, fine print, images and other product listing details should not be copied from other Jane sellers, online platforms, or online channels that you do not control. Plagiarism will not be tolerated.
- Sellers must ensure that products, product names, descriptions, fine print, images and other product listing details do not infringe on the trademark, copyright, or patent of any third-party. Listing counterfeit products on the Jane marketplace will not be tolerated. Jane will expel repeat infringers and reserves the right to remove sellers even after one infringement.
- A listing should maintain a low percentage of 1-star reviews. Jane reserves the right to remove listings that do not meet this standard.

- Product Name
- SKU
- Category
- Subcategory

To help make the buying and selling experience enjoyable for everyone, please follow these listing standards when creating a product listing. Remember that great content helps drive sales!
Product Name
Product names must be clear and concise and should also be descriptive of the product being sold. The product name appears with the main featured image throughout the Jane platform on the home feed, category feeds, the product detail screen as well as other promotional placements. The product name is also often used in external marketing efforts, so failure to follow these minimum requirements can lead to exclusion from external Jane marketing placements.

The main featured image must be original to the seller or they must have sole rights to the image. For the main featured image, no third-party stock or commercial photography will be allowed unless the seller owns sole rights to use that image. The main featured image may not be created, produced, rendered or altered with image editing software. For example, a seller should not use Photoshop or other image editing tools or software to modify the background of the image or alter the model’s body or change the text on a shirt.
Jane requires that sellers own a license to use all photos in a product listing. Don't use photos that infringe on the intellectual property rights of others. For best results use a clean, simple font and be sure the text is legible. For best results use the same location to place the descriptive text overlay on all images in the product listing (e.g., bottom left corner on all images).

Prohibited Items
Jane strives to maintain a Marketplace that customers can trust and one that is legally compliant. Jane will provide the utmost level of autonomy to our Sellers regarding items that can be listed on Jane.com. However, there are instances when it is in the best interest of the company and the Sellers, we represent to prohibit a selection of items from being available to our consumers. These instances include scenarios where regulatory restrictions apply or items are not in alignment with Jane’s values, mission, or vision. All products listed for sale on Jane Marketplace must comply with any applicable local, state, and federal laws and regulations. Further, if you sell products containing feathers, you should also consult the Migratory Bird Treaty Act of 1918.
4. Cosmetics
Cosmetics are products that are usually rubbed, poured, sprinkled, or sprayed onto the body for cleansing, beautifying, or changing the appearance of the body. Any cosmetics sold on Jane must be new and unused and sealed in the original manufacturer’s packaging. For more information, see the U.S. Food and Drug Administration's resources Is It Really 'FDA Approved?' and Is It a Cosmetic, a Drug, or Both? (Or Is It Soap?).
5. Counterfeits, Unlicensed/Unauthorized Products, and Labeling
Counterfeits
Counterfeit items or imitation products created with the intention to deceive or defraud consumers are prohibited from being listed on the marketplace. Jane expels repeat infringers but reserves the right to remove sellers even after one infringement.
Products with removed or altered serial numbers, tags, care instructions are prohibited on Jane. Sellers are responsible for ensuring that their product and product listing is applicable to all laws.

Unlicensed Products
Jane prohibits Sellers from listing copyrighted, patented or trademarked brands without a resale agreement, license or formal authorization with the party owning such rights.
A license is a legally protected agreement or letter of authorization that allows a third party to use a company’s trademark, brand, name or likeness to sell products.
For example, Sellers who intend to sell items with logos or teams from the NFL, MLB, NBA or other sports teams should obtain a licensing agreement with the applicable leagues or association prior to listing an item on Jane.
An additional example is use of fabrics containing copyrighted or trademarked properties. These fabrics typically have a disclaimer that explains the fabric is being sold for noncommercial home use only and that all other uses are prohibited. Mass-production of items made with these fabrics require a license or agreement with the copyright or trademark owner. Reach out to compliance@jane.com for further clarification or examples.
Jane prohibits real or replica government, law enforcement, security, or military or paramilitary badges. Official emergency lighting systems or sirens, including lenses or LEDs for these systems are also prohibited.
Jane reserves the right to request that a Seller provide additional information, such as a brand licensing agreement, letter of resale or authorization letter for any product listed for sale on Jane.
6. Dangerous or Hazardous Items
For safety reasons and due to complex legal regulations surrounding certain items, Jane prohibits items that could be considered dangerous or hazardous.
Due to the potential harm caused by hazardous materials, as well as complex legal regulations surrounding such materials, including shipping restrictions, hazardous materials are prohibited on Jane.
Dangerous or hazardous items are not permitted, and includes:

Jane requires Sellers to follow all applicable laws for the items they list and to abide by the laws of the markets in which they sell. This may obligate a Seller to include warnings or disclaimers in their product listing.
For example, California’s “Safe Drinking Water and Toxic Enforcement Act of 1986,” more commonly known as Proposition 65, requires businesses who sell in California to provide warnings to consumers about “significant exposures to chemicals that cause cancer, birth defects or other reproductive harm.” See the full list prior to listing your product on Jane because you may be required to post a warning in your product description alerting potential buyers of the warning prior to purchase and/or affix a warning to the item being shipped to California consumers.
7. Dietary Supplements and Vitamins
Dietary supplements are vitamins, minerals, herbs, or other substances (like amino acids or fatty acids) eaten to supplement the diet. They often come in forms like pills, tablets, capsules, softgels, gelcaps, powders, or liquids.
Dietary or food supplements are often subject to legal regulations. These regulations vary but may include labelling and testing requirements, restrictions on specific ingredients, and guidelines about what types of medical drug claims can be made. Read the FDA and FTC guidelines and rules. It is the seller’s sole responsibility to follow rules and regulations regarding supplements and vitamins.
Any product listing for supplements must be correctly described and labeled.
8. Documents, Identification Cards, Mailing Lists
Documents or Identification Cards
Jane prohibits Sellers from listing documents for sale when that document purports to be from an official governmental or industrial body, including licenses, identification cards, birth certificates, passports, patches, collars, or tags.
Mailing Lists
Jane prohibits Sellers from listing products that infringe upon an individual’s privacy, such as the sale of mailing lists or other personal information.

11. Food and Beverage
Jane takes the health and safety of its customers very seriously, so when creating product listings for food or beverage intended for human consumption, Sellers should familiarize themselves with federal, state and local laws and regulations. There are a number of government regulations that dictate who can make, package, and sell food and beverage. Zoning laws in your area may govern kitchen inspections, requiring you to keep inventory on-hand for a specific time, listing ingredients or operating in a commercial kitchen.
Learn more about the rules for running a food business at the national level through the Food and Drug Administration.
At the state level, cottage food laws determine whether you're allowed to make certain types of food from your home kitchen to then sell at certain types of venues. Learn more about the specifics of cottage food laws at Forrager.org.
For example, Forrager details the startup process that Utah-based sellers will need to follow so that they will be able to provide sufficient document to Jane before selling cottage food products:
“The $107 (or more) process involves a business license application, food handler training, a home inspection, and a cottage food product application, which includes detailed written recipes and possibly product testing at a lab. Utah has a number of requirements for the operation’s workspace, and one uncommon requirement is that operators must keep a 14-day sample of every batch of food they make.”
Products for consumption need to be shipped appropriately to protect the quality and safety of the food, to avoid spoilage, melting, damage, and so on. Any food or beverage products must be properly prepared and sealed and must be appropriately packaged and labeled. USPS, UPS, FedEx and the Food and Drug Administration provide resources for helping you decide what and where you can ship.
When Sellers list food or beverage items, they certify that he or she has met all safety conditions and are adhering to federal and state laws. Here are a few examples:
- Ingredients: Federal and state laws require labels to state, among other things, the food's ingredients, nutrition information, and place of manufacture.
- Food licenses: Almost all states require food manufacturers and sellers to register with or obtain a license and appropriate permits from the state.
- Import/export: Laws restrict the import and export of many food products.

Laws regarding the sale of edibles vary from place to place, so please consult an attorney or qualified legal expert if you have any further questions.

Jane is intended to be an inclusive community where people from all backgrounds, nationalities, religions, political affiliations, and even different types of artistic taste and humor feel welcome. While sellers are responsible for the products they list, we encourage adherence to our guidelines to ensure that all listings respect cultural differences and sensitivities.
In any event, Jane does not allow items or listings that promote, harass or support hatred toward people based on: age, color, ethnicity, disability, genetic condition, family status, marital status, national origin, race, religion, sex, gender identity, or sexual orientation, or other items or content that promote people organizations with such views.
Jane tends to allow items that have educational, historical, or artistic value, but we know that even those items are subject to various and conflicting interpretations.

- Religious symbols

Certain items that are subject to complex legal regulations or registration systems are also prohibited and include motor vehicles (for example: automobiles, motorcycles, boats, scooters, travel trailers, etc.) or other vehicles requiring registration.

The only exception to this rule is regarding products that allow access to goods or services for a fixed duration and price, and do not require an additional or recurring payment or purchase.
For example, it would be appropriate for a Seller to list a disc or USB drive containing software access for one-year at a price of $99 so long as no additional purchase or charges are expected of the customer for the duration of the service or access being offered.
Another example is a 6-month magazine subscription for a fixed price.

If a seller ships the wrong product, or if the product received is significantly different from representation or description at point of purchase, or if a personalized item has been customized incorrectly, the following applies:
- The customer can request a refund or a replacement.
- If the customer wants a replacement and the seller has inventory, they must ship the customer the correct product within 2 business days for all product categories except replacement handmade and/or personalized items, which must be shipped within 6 business days.
- The seller can either allow the customer to keep the incorrect product, or provide the customer with a return mailing label to return the original item.
- When the return of an incorrect item is asked for, a customer has 7 business days from the date they receive their replacement item to ship the incorrect product to the seller. If a customer receives a replacement item and the seller does not receive the incorrect, original product back within 14 business days, the customer will be charged for the replacement product.
- Once the new product is received by the customer and the customer is satisfied, they will have 7 days to ship the incorrect product back with the prepaid label (if the seller requires the return). If the seller requires the return, and does not receive the original order within 14 days, the customer will be charged for the replacement item.
- If the customer requests a refund on an incorrect product, Jane will issue the refund. The seller can either allow the customer to keep the incorrect product, or provide the customer with a return mailing label to return the incorrect item.
Returns Due To Late Shipping
All orders must be shipped within 24 hrs of the tracking number being uploaded to Jane. The tracking number should not change once it is uploaded. If a seller uploads a tracking number, and has not shipped the product within 3 business days (“Processing” status), and the customer contacts Jane, we will contact the seller who then has 2 business days to respond. After that, Jane will cancel the order and refund the customer.
If there is nothing wrong with the product, if it is as described and represented at point of purchase, however the customer does not like it for any reason, the customer will be provided with the return shipping information and is responsible for paying for the return shipping cost.
The customer will be refunded for undamaged product returns once they provide Jane with tracking information for the shipped return.
Refunds will be credited back to the original payment method used by the customer. Jane will deduct the refund amount from a seller’s next payment or send an invoice for the refund amount.
Jane will reimburse a seller upon request if an undamaged/correct product being returned is not received by the seller from the customer within the return window of 30 days from the receipt of the item.
If a customer initiates a return through the seller, please refer the customer to Jane.
When Jane Support processes a return, the seller’s listed return address will be provided to the customer. To avoid a seller being charged for a returned item not received, the seller is responsible for correct and accurate return address information listed under “Business Info” within their Seller Admin.
Return Shipping
The customer is responsible for initial shipping costs. Any refund resulting from a return will not include the initial shipping costs.
The customer is responsible for return shipping costs unless they receive an incorrect item or damaged item. In the case of incorrect items, the seller can either allow the customer to keep the incorrect product, or provide the customer with a return mailing label to return the original item to the seller.
Sellers are prohibited from using Fulfillment by Amazon (FBA) to ship any orders to Jane customers. All orders must be delivered within 5 days of order fulfillment.
Seller Requested Refunds Due to Inventory Issues
If the seller sends a list of orders to be refunded due to lack of inventory (over-selling) or damaged inventory, the seller must send Jane the order numbers to be refunded and a 15% non-fulfillment fee will be applied.
Non-Returnable Items
General non-returnable items:
- Digital downloads
- Personalized items
- Perishable Goods (Food & Beverage, Vitamins & Supplements, etc.)
- Health & Personal Care Items (Hair Care, Makeup, Skincare, Bath & Body, Fragrance, Oral Care, Feminine Products, Shaving, Soap, Deodorant, Nail Care, etc.)
- Intimate Apparel (Swimwear, Underwear, Bodysuits, Lingerie, Shapewear, etc.)
Seller Communication
Communication between our sellers and customers is a key component to a healthy marketplace. We know it’s important for our sellers to be able to communicate easily with customers. And it’s important that our customers feel safe when they provide their contact and payment information. Receiving unwanted messages, emails and marketing offers after making a purchase takes away from the enjoyable and safe transaction.
In general, Jane provides sellers with customer information such as physical mailing addresses solely for the purpose of completing and fulfilling an order or responding to a customer service question. Sellers will communicate directly with customers within the Jane Portal. All messages must be directly related to a customer's order. Marketing messages or promotional content are strictly prohibited. Do not request or share personal information beyond what is necessary for fulfilling the order or addressing the customer’s concern. Respect customer privacy at all times.
We encourage open and honest communication between sellers and customers. In order to protect our customers and create a safe selling platform, we have guidelines and policies that cover how our sellers can communicate with Jane customers.
Policy Summary
We do NOT allow our sellers to:
- Send unsolicited commercial messages, telemarketing phone calls or text messages, or any sort of direct mail to Jane customers.
- Contact a customer or another seller after they have explicitly asked you not to.
- Threaten or use profanity or hate speech.
- Refer to or promote the seller’s website or apps that facilitate sales outside of the Jane platform.
- Include marketing or sales promotional materials in shipping boxes or packages sent to customers. This includes, but is not limited to, a coupon/discount to an external website on your packaging insert.
- Use customer information to create marketing audiences or lists to be used in advertising efforts.
- Sellers should not proactively email or message any Jane customers regarding the confirmation, shipment or delivery about a Jane.com purchase, as those communications are handled by Jane.
- Respond inappropriately to reviews left by customers on a product listing page.
- Interfere with a transaction or the business of another seller.
- Sellers are prohibited from including their company, website, phone number, or email addresses on product listings, and may not put links on the “About” page portion of seller storefronts on Jane.com.
Misuse of customer information, is a violation of the Jane Seller Contract and may also be infringing on applicable privacy laws, including regulations and/or rules relating to direct marketing, advertising, targeting, e-mails, text messages, robocalls, telemarketing or other electronic commercial messages, including without limitation the CAN-SPAM Act and other applicable legal and regulatory requirements.
Any violation to the Jane Seller Communication Policy may result in seller restrictions or the suspension of selling privileges or expulsion from the platform. All fees paid or payable in relation to product listings or seller accounts on which we take any action may not be refunded or otherwise credited to that seller account.
Other marketing assets such as flyers, pamphlets etc in shipping packages are no longer acceptable.
Full Policy
Customer service requests must be appropriately responded to within 1 business days of being contacted directly by the customer or by Jane’s Support team.
We encourage open and honest communication between sellers and customers. But we don't allow our sellers to communicate with Jane customers to send spam, threats, profanity, hate speech, or offers to buy or sell outside of the Jane platform.
Sellers are always encouraged to assist customers with customer service requests.
Examples of acceptable customer support communication:
- A customer might reach out requesting a return
- A customer might reach out with a question about sizing or washing instructions
- A seller might have an issue on a deal that needs to be corrected quickly and wants to communicate with any purchasing customers before fulfilling those orders
Sellers may not proactively email or message Jane customers regarding the confirmation, shipment or delivery of a Jane.com purchase, as those communications are handled exclusively by Jane. For purposes of clarity, Sellers are allowed to respond to inquiries from customers. These messages, and any other form of communication with the customer shall be considered unsolicited and will result in potential account limitations or account termination. We investigate and take action on all reports of inappropriate communication.
All orders must be shipped within 24 hours of the tracking number being uploaded to Jane. Jane reserves the right to use their best judgment in taking care of customers as unique situations arise. For handmade, personalized, and/or custom orders, the order will not be canceled, refunded, or changed in any way without contacting the seller first to confirm that the change is acceptable. Jane does reserve the right to use its best judgment in taking care of the customer as unique situations arise.
All customized purchases or personalized items are final. Custom products are when a customer makes more than one selection, excluding size.
For other handmade products that are non-customized/non-personalized, if for any reason the customer is unhappy with their purchase, the customer can initiate the return/exchange within 14 calendar days of receiving the item. They then have up to 30 days from the receipt of the item to return the product to the seller (unless the product is determined to be damaged or defective, excluding carrier damage during shipping).
For more information, please refer to Jane's Shipping and Fulfillment Policy.
Marketing promotional emails
We strictly prohibit any form of commercial marketing or promotional email communication with Jane customers. This includes, but is not limited to, spam emails. “Spam” is an email (or message) that is both unsolicited and commercial in nature.
Receiving unwanted emails, messages and marketing offers after making a purchase takes away from the enjoyable and safe transaction on the Jane platform. We define unsolicited as something a recipient receives but did not request. We define commercial as a message that discusses buying, selling, or trading of goods or services.
Email communication content that is not allowed:
- Offers to facilitate a transaction of products or goods outside of the Jane platform.
- Messages that refer to or promote external websites that facilitate sales outside of the Jane platform.
- Any promotions for additional products or referrals to third-party products or promotions.
- Invitation to join a mailing list.
- Requests for donations.
- Any form of communication about the confirmation, shipment or delivery of a Jane.com purchase.
If you have received unwanted email communication from a Jane seller, please forward the message to compliance@jane.com.
Threats
We have a zero-tolerance stance on threats, harassment, or abuse of any form in email or messaging communication. This includes fighting words, physical threats and incitement to imminent lawless action.
Threats in any messages between sellers and other sellers, between sellers and customers, or between sellers and Jane employees will not be tolerated.
If you receive a threat, please inform us immediately and report it to law enforcement.
Hate speech and profanity
We do not allow hate speech and profanity on the Jane platform or in any seller and customer communication because it creates an environment of intimidation and exclusion and in some cases may promote real-world violence.
We define hate speech as a direct attack on people based on characteristics such as race, ethnicity, national origin, religious affiliation, sexual orientation, gender, gender identity, and serious disease or disability. We define attack as violent or dehumanizing speech, statements of inferiority, or calls for exclusion or segregation.
Profane terms and phrases are often used with the intent of insult and are often directed at a target in a manner of intimidation or threat and as such will not be allowed on the Jane platform or in any email or messaging communication.
Other inappropriate commercial actions
Sellers are prohibited from using customer email addresses or physical mailing addresses to create any sort of marketing audiences or lists, including but not limited to Facebook advertising audiences or Google advertising audiences.
It is also prohibited to use customer information to enrich or enhance a database with the intent of marketing in any form, including but not limited to, direct mail, telemarketing, or digital email marketing.
It is prohibited to sell, trade, or rent customer information, including email addresses, to third parties.
Reviews
Reviews, both positive and negative, are essential to the authenticity of a marketplace and are key to helping a seller build a reputation on the Jane platform.
Customers can leave a review within 60 days after their item was delivered. Customers can edit their review any number of times during that 60 day period until the seller has responded to the review or if the order has been refunded.
A seller should not contact a customer to solicit reviews of their product listings. The Jane platform automatically triggers an email upon order delivery, prompting the customer to leave an honest review of their purchase. Sending additional review requests from the seller would duplicate efforts and create confusion for the customer.
It is also prohibited to offer customers any compensation for a review, including money or gift cards, free or discounted products, refunds or reimbursements, or any other future benefits.
Jane allows sellers to respond to reviews left on their product listings. On the occasion you receive an unfavorable review, you can reach out to the customer via email to remedy the situation or, if the review is less than 3 stars, leave a response on the review.
Reviews and your response to reviews must adhere to the communication policies set forth in this Seller Communication Policy. Your response to a review may not:
- Contain private information
- Contain obscene, racist, or harassing language;
- Contain threats or extortion;
- Contain advertising or spam; or
- Undermine the integrity of the Reviews system.
If you understand what led a customer to leave a negative review, offer a solution that helps address the issues raised in the review. Negative reviews are an opportunity to learn how you can improve your shopping experiences.
If you’re unsure what caused a negative review, remain professional and courteous. It’s best to ask open questions that help you understand what caused the customer’s negative experience. Focus on whether you can solve their problem and clear up any misunderstandings. Responding quickly and showing that you’re willing to address the issue may lead a customer to edit their review. Do not require the customer to modify or edit their review. For example, you cannot say to a customer “IF you modify your review, THEN we will remedy the situation.”
Since your response will be public and viewable by other shoppers, here are some tips for responding:
- Keep it short and simple;
- Respond in a positive and professional way that reflects well on you, your business, and your customer service;
- Address the specific concerns from the review and any changes you made as a result; and
- Focus on your product and service, not the reviewer.
Your response will appear in the Ratings & Reviews section of product listing pages and on your Seller profile page. You have 60 days to respond to the customer’s review from the date the order was shipped.
Once you respond to a review, the customer will no longer be able to edit their original review or rating. The customer can’t respond on your reviews page.
Interference
Interference occurs when a seller intentionally interferes with another seller’s business on the Jane platform in order to drive away their business. Interference is strictly prohibited on Jane.
Examples of interference include:
- Contacting another seller or a customer to warn them away from a particular seller or seller’s product listing.
- Posting in public areas such as social media, or other platforms to demonstrate or discuss a dispute with another seller.
- Purchasing from a seller for the sole purpose of leaving a negative review.
- Purchasing from a seller for the sole purpose of replicating a competing version of that product.
Shipping and Fulfillment
Sellers are responsible for shipping and fulfilling products to customers within 2 business days of order confirmation for all product categories with the exception of handmade and/or personalized products, including graphic tees, which must be shipped within 6 business days of order confirmation, excluding holidays and weekends. Fulfillment should begin the moment a successful order is completed. Each order must be delivered within 5 days of order fulfillment.
Each order must be delivered to the customer within 5 days of order fulfillment. It is the seller's responsibility to select a reliable shipping method that ensures timely delivery within this specified timeframe.
If you're using a shipping or fulfillment service, please keep in mind that you are ultimately responsible for understanding Jane’s shipping and fulfillment policies and making sure that your customers receive their orders.
Pricing
Sellers should charge an appropriate amount for shipping that is consistent with the shipping policies listed on their own website or other online sales channels they control. Inflated shipping costs could lead to expulsion from the Jane marketplace.
Sellers should not artificially inflate shipping prices on their own website or other online sales channels in order to create parity pricing with the same product listed on Jane.
Packaging
Seller must remove any packaging provided by Seller’s vendor, and place Item in a new cardboard box or other new packaging. Seller’s branded packaging must conform to the labeling requirements of all countries to which Items are shipped.
Packaging must be clean and free of any damage, markings and non-product related labels and stickers.
Packaging cannot contain any marketing or sales promotional materials related to the seller’s website or other online sales channels controlled by the seller.
Products and accessories must be compartmentalized and secured to ensure they are not in direct contact with each other and do not move inside the packaging during handling and shipping. Packaging cannot include non-Jane.com email addresses or links to any non-Jane.com website.
Product packaging must pass drop-tests based on widely adopted standards like those of the American Society for Testing & Materials (ASTM) or the International Safe Transit Association (ISTA).
Shipment of products containing lithium batteries (both lithium ion and lithium metal) are classified as Class 9 – Miscellaneous Dangerous Goods. Please ensure that you follow all legal requirements as the product might require proper identification, classification, packaging, marking and labeling.
Tracking Information
Orders that have a destination in the United States must include tracking information. Tracking information must be uploaded into the Jane system before payment is released.
By uploading tracking information into the Jane system, you're giving us permission to collect and share this data received from your chosen shipping carrier with the customer.
All orders must be shipped with an approved shipping carrier. All shipped orders must receive an acceptance scan by the carrier within 2 calendar days of being marked as shipped on Jane. All tracking must show a delivered scan when the package arrives to the customer.
All orders must be shipped within 24 hrs of the tracking number being uploaded to Jane. The tracking number should not change once uploaded.
If a seller refunds an order that does not have a refund request from Jane or the customer, the seller is liable for a 15% non-fulfillment fee associated with that order.
In the unlikely event an order does not arrive at the customer’s shipping address, you will be required to provide valid proof of shipping. Valid proof of shipping must show that the item actually was shipped and that it was sent to the address provided on Jane. The seller will be required to file a claim with the carrier and issue a refund to the customer.
Shipping and Fulfillment Timelines
All paid orders must be fulfilled within 2 business days of order confirmation, and within 6 business days of order confirmation for any items that are handmade or personalized, including graphic tees, excluding holidays and weekends. Each order must be delivered within 5 days of the order fulfillment date.
Most sellers fulfill orders within 1-2 business days. If an order is not fulfilled, it will be refunded and the seller will be charged the seller fees for the order. Failure to fulfill orders in excess may result in a suspension of selling privileges.
Sellers must ship all packages from within the United States. Sellers found to be shipping items with origin points outside of the United States risk having seller privileges revoked.
Please note that shipping metrics have a highly meaningful impact on the Jane Seller Rating scoring system.
Jane completes audits on orders that remain unfulfilled and non-delivered. If an order remains unfulfilled 15 days after order placement, the order will be refunded, and a 15% non-fulfillment fee will be charged.
Drop-Shipping
Drop-shipping, also known as product sourcing, or allowing a third-party supplier to fulfill orders to customers on your behalf, is generally acceptable. Remember that if you use drop shipping, you are still responsible for the safe delivery of the item within the time-frame indicated on your product listing page and you are ultimately responsible for instructing any third-party suppliers on the rules within this Shipping and Fulfillment Policy.
If you intend to fulfill orders using a drop shipper, you must always:
- Be the seller of record of your products;
- Identify yourself as the seller of your products on all packing slips, external packaging, and other information included or provided in connection with them;
- Remove any packing slips, invoices, external packaging, or other information identifying a third-party drop shipper prior to shipping the order;
- Be responsible for accepting and processing customer returns of your products;
- Never utilize Fulfillment by Amazon (FBA) for any purchases made on Jane.com; and
- Comply with all other terms of your Seller Contract and applicable Jane police
Listing an item on Jane and then purchasing the item from another retailer or marketplace that ships directly to your customer is prohibited. It is a direct violation of the Inventory Policy and is not allowed on Jane.
Policy Enforcement
Jane has a zero-tolerance policy towards any sales fulfillment and shipping violations listed here:
- Sending empty packages.
- Shipping a product different than what was ordered.
- Falsifying tracking information.
- Sending packages to an address that doesn’t match the address on the order confirmation, unless directly requested by the customer.
- Excessive unilateral refunds.
- Excessive orders failing to receive acceptance scans by the carrier and/or excessive orders receiving acceptance scans late.
If we determine that a seller is in violation of our fulfillment policies, we take immediate actions that include, but are not limited to:
- Immediate refunds to all affected customer shipments.
- Immediate and permanent withdrawal of the seller’s selling privileges on the Jane platform and withholding of funds.
- The removal of all the product’s reviews and preventing the product and seller from receiving future reviews.
- Legal action against the seller, including lawsuits and referral to civil and criminal enforcement authorities.
- Disclosing the seller’s name and other related information publicly.
Automated Package Verification (APV)
Seller is responsible for any APV charges passed to Jane via third parties and Jane reserves the right to deduct any APV charges from the seller ledger.
Tagging and Labelling
Removing labels or tags in an attempt to hide the original purchasing source of a product is prohibited on Jane.
Clothing
The regulations require that you include the following information on your labels:
- The fiber content and the fabric’s country of origin
- The country of origin (where the item was manufactured)
- The name or business name that is responsible for manufacturing the item; and
- Care instructions.
If you will be relabeling the items, you have additional responsibilities. First, you must leave the fiber content, its country of origin and the country of manufacturing origin as you got it. Even if you are restyling the garment (many t-shirt producers fall in this category) you cannot change the country of manufacture to reflect your location. This cannot change. If you change either of these two elements, you would be guilty of violating the U.S. Textile Act. For additional information, please refer to the FTC’s guidelines.
Cosmetics
Cosmetics labels and product listing pages must be labeled in English with the following information:
- The name of the product.
- The purpose or use of the product (e.g. cleansing the body, reducing the appearance of wrinkles, moisturizing the skin).
- The amount of content of the cosmetic, in terms of weight, measure, count or a combination (e.g. 30 oz, 5 mL, 10 pills, 5 lbs).
- The ingredient list.
- The name and address of the manufacturer, packer, or distributor.
- Any necessary label warnings.
Cosmetic labels and product listing pages must not:
- State that the products cure, mitigate, treat, or prevent a disease in humans unless that statement is approved by the FDA and the product is properly labeled as both a cosmetic and a drug.
- State that the cosmetics are “FDA approved” if they are not FDA approved.
- Use the FDA logo.
- Be labeled “tester,” “not for retail sale,” or “not intended for resale”.
For more information, see the U.S. Food and Drug Administration's resources Summary of Labeling Requirements and Cosmetics Labeling Claims.
Food and Beverage
When it comes to labeling your packaged products, the Fair Packaging and Labeling Act stipulates that "all food products should be labeled with disclosure of ingredients, quantity and weight of ingredients and labeled with the name and place of the person or business who makes and packages these goods." We also suggest that food sellers list any allergens in the food to ensure a better user experience.
All food or beverage packaging must include the following:
- Product name.
- The name and address of the packaging company.
- Have a clearly marked expiration or use-by date and be delivered to the customer before the expiration date.
- A list of the ingredients, net content quantity and weight (the weight of the contents, not including packaging).
- Not be altered or changed in any way.
- Follow food storage guidelines appropriately before and as you ship items in accordance with all applicable laws and regulations.
